User Agreement

This User Agreement (the "Agreement") governs the relationship between «ATB RECRUITING» MCHJ XBA (the "Operator") and any person using the Naxodim top! platform (https://nxtop.uz and the mobile applications, the "Service"). The Agreement is a contract of adhesion; registration in the Service or actual use of its features constitutes acceptance. If you disagree with any term, you must refrain from using the Service.
1. Definitions
Service — the software, databases and content available at nxtop.uz and via the Naxodim top mobile applications.
User — a legally capable natural person who has accepted the Agreement. Job seeker — a User seeking employment. Employer — a User acting on behalf of a legal entity or individual entrepreneur for recruitment purposes and confirming due authority.
User Content — any materials posted by the User: CVs, vacancies, messages, reviews, images and other data.
2. Subject matter and acceptance
The Operator grants the User the right to use the Service for its intended purpose: posting and searching vacancies and CVs, applications, messaging and related information features.
Registration and core functionality are free of charge. Certain services for Employers are provided for a fee under the Public Offer, which forms an integral part of this Agreement.
Acceptance is made by registration or actual use of the Service and is equivalent to a contract in simple written form under Articles 367 and 370 of the Civil Code of the Republic of Uzbekistan and the Law "On Electronic Commerce".
3. Account
The User undertakes to provide accurate and current information and keep it up to date. Registration on behalf of another person without authority and creation of multiple accounts for bad-faith purposes are prohibited.
The User is responsible for the confidentiality of access credentials and for all actions performed under their account, and must promptly notify the Operator of any compromise.
A User may combine the job seeker and employer workspaces; employees of an Employer may be added to the company's team access, and team members' actions are deemed actions of the Employer.
4. General rules of use
The User undertakes to use the Service in good faith and in compliance with the legislation of the Republic of Uzbekistan and this Agreement.
The following is prohibited: posting false or misleading information; vacancies or CVs unrelated to genuine employment (including pyramid schemes and "jobs" with mandatory entry fees); discriminatory requirements unrelated to professional qualities; content violating third-party rights or the law; spam; automated data collection (scraping); circumvention of technical restrictions or paid mechanisms; actions disrupting the normal operation of the Service.
The Operator may use automated (including algorithmic) and manual tools to verify content and activity.
5. Terms for job seekers
The job seeker determines the content of the CV and its visibility mode (public / by link / hidden) and may restrict access for particular companies.
By publishing a CV openly, the job seeker consents to its viewing by registered Employers and to disclosure of contact details as described in the Privacy Policy.
By applying to a vacancy, the job seeker consents to the transfer of the CV and contact details to the relevant Employer.
6. Terms for employers
The Employer warrants that its vacancies are genuine, comply with labour legislation and contain no discriminatory requirements.
Vacancies are moderated and published upon approval; the Operator may reject a vacancy stating the reason.
Having obtained job seekers' personal data, the Employer must process it solely for recruitment, must not transfer it to third parties or use it for mailings or other extraneous purposes, and must comply with personal data legislation. The Employer bears responsibility for such processing.
7. Content and moderation
The User retains rights to their Content and grants the Operator a free non-exclusive licence to use it to the extent necessary for the operation of the Service (storage, display, technical processing, automatic translation into interface languages).
The User warrants ownership of all rights to the posted Content and its non-infringement of third-party rights.
The Operator may (but is not obliged to) moderate Content and may hide or remove Content violating the Agreement or the law, including upon a substantiated third-party complaint.
8. Intellectual property
Exclusive rights to the Service, including the code, design, the Naxodim top! trademark, databases and interface elements, belong to the Operator. Use of Service elements beyond its ordinary functionality without the Operator's written permission is prohibited.
9. Paid services
The list, prices and procedure of paid services are set out in the Public Offer published in the Service. By paying for services the Employer accepts the Offer.
10. Limitation of liability
The Service is provided "as is". The Operator is an information intermediary, is not a party to relations between job seekers and Employers or to employment contracts, and does not guarantee employment, filling of a vacancy or the accuracy of user-posted information.
The Operator is not liable for lost profit or indirect losses. In any case the Operator's aggregate liability to an Employer is limited to the amounts paid by that Employer for paid services during the last three months.
The Operator takes reasonable efforts to ensure uninterrupted operation but does not guarantee the absence of interruptions caused by maintenance or circumstances beyond its control.
11. Suspension and termination
In case of violation of the Agreement the Operator may restrict, suspend or terminate the User's access (in whole or to particular features) and hide or delete the violator's Content; in case of material or repeated violations — without prior notice.
The User may stop using the Service and delete the account at any time.
12. Governing law and disputes
The relations of the parties are governed by the law of the Republic of Uzbekistan.
Disputes are resolved through negotiations with a mandatory pre-trial claim procedure: claims are sent to info@nxtop.uz, response time — fifteen business days. Failing agreement, disputes are referred to the court at the Operator's location unless mandatory rules (including consumer protection legislation) provide otherwise.
13. Final provisions
The Operator may amend the Agreement; the new version takes effect upon publication in the Service. Continued use constitutes acceptance.
Invalidity of any provision does not affect the validity of the remaining provisions.
The Agreement is made in Russian, Uzbek and English; in case of discrepancies the Russian version prevails.
